1. DESCRIPTION OF SERVICES

PosDo is a next-generation restaurant management platform that utilizes the latest web, mobile, and social networking technologies to allow restaurants to manage their operations and customers to discover and order from their favorite restaurants.

Although you can place orders through our Services, PosDo itself does not sell the products contained in your order, is not a party to any such transaction, and has no control over the quality or safety of the products. Your order is between you and the restaurant from which you order.

Restaurants may state ingredients or represent allergen or food preparation standards through our Services. We do not investigate or verify menus, ingredients, or food preparation standards. If you have food allergies or specific preparation requirements, you are strongly advised to contact the restaurant directly.

Your use of payment methods such as Google Pay, Apple Pay, Stripe, or PayPal is subject to their respective terms and conditions.

PosDo uses Google Maps and the Google Maps API as part of our platform. By using PosDo's systems you are also bound to the Google Maps API Terms of Service.

2. COMMUNITY GUIDELINES

PosDo's community functions best when users follow these simple rules. By accessing our Services, you agree to:

• Not use the Services for any unlawful purpose or fraudulent activity
• Not access or use the Services to collect market research for competing businesses
• Not upload, post, or transmit content that infringes copyrights, is threatening, defamatory, or invasive of privacy
• Not impersonate any person or entity or misrepresent your affiliation
• Not use automated means like spiders, robots, or crawlers to scrape data from our Platform
• Not create multiple accounts to obtain promotions multiple times
• Not interfere with the proper operation of our Services through viruses, hacking, or unauthorized access attempts

3. RESTRICTIONS

Our Services are available for individuals aged 13 years or older. If you are 13 or older but under 18, you should review this Agreement with your parent or guardian.

You may not use our Services to purchase alcohol unless you meet minimum age requirements and present valid photo identification.

Restaurants on our Platform are prohibited from selling tobacco or nicotine products including cigarettes and e-cigarettes. Attempting to purchase such products is prohibited.

PosDo enforces a maximum order amount of €2,000 per order. We reserve the right to modify this maximum at any time.

4. PAYMENT; REFUNDS

You agree that PosDo may immediately authorize your payment method for any order made under your account.

You are responsible for all activities and charges that occur under your account. Your liability continues after termination of this Agreement.

If you have questions about transactions, please contact customer service through our support channels.

All refunds are subject to restaurant refund policies. If you contact us seeking a refund, we cannot process any refund until we receive approval from the applicable restaurant.

PosDo is responsible for the security of cardholder data and complies with Payment Card Industry Data Security Standard (PCI-DSS).

5. SIGN-IN NAME; PASSWORD; UNIQUE IDENTIFIERS

During registration, you must create an account with a unique sign-in name, password, and provide true, accurate, current, and complete information.

You are responsible for the confidentiality and use of your sign-in credentials. You will promptly inform us of any need to deactivate your account.

We reserve the right to delete or change your credentials at any time and for any reason.

6. INTELLECTUAL PROPERTY

Our Services contain material such as software, text, graphics, images, and other content owned by us or third parties. This Content is protected under copyright, trademark, and other laws.

You have no rights in or to the Content, and you may not use the Content except as permitted under this Agreement. You may not sell, transfer, assign, license, or modify the Content.

The trademarks, service marks, and logos of PosDo used on our Services are registered and unregistered trademarks of EzzyPush.

Elements of our Services are protected by trade dress, trademark, and other laws and may not be copied or imitated.

7. COMMUNICATIONS AND USER SUBMISSIONS

We encourage communication but do not want confidential information via email. We may freely use ideas, concepts, or techniques from your communications for any purpose.

You retain copyrights in content you post but grant us an irrevocable, non-exclusive, worldwide, perpetual, royalty-free license to use, modify, copy, distribute, and create derivative works from your submissions.

8. NO WARRANTIES/LIMITATION OF LIABILITY

WE SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES FROM LOST DATA. ANY DIRECT DAMAGES SHALL BE LIMITED TO THE MONIES YOU HAVE PAID US DURING THE THREE (3) MONTHS PRECEDING THE EVENTS GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

THE SERVICES MAY CONTAIN TECHNICAL INACCURACIES, TYPOGRAPHICAL ERRORS, INCLUDING WITH RESPECT TO ALLERGY INFORMATION. WE ARE NOT RESPONSIBLE FOR SUCH ERRORS.

WE RESERVE THE RIGHT TO CANCEL OR MODIFY ORDERS WHERE FRAUDULENT OR INAPPROPRIATE ACTIVITY IS SUSPECTED.

9. EXTERNAL SITES

Our Services may contain links to third-party websites ("External Sites"). These links are provided solely as a convenience and not as an endorsement. We are not responsible for the content of External Sites.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from claims, actions, or demands arising from your breach of this Agreement or misuse of our Services.

11. COMPLIANCE WITH APPLICABLE LAWS

Our Services are based in Spain and the European Union. If you access our Services from outside the EU, you do so at your own risk and are responsible for compliance with local laws.

12. TERMINATION OF THE AGREEMENT

We reserve the right to restrict, suspend, or terminate this Agreement and your access to our Services at any time without prior notice. We may change, suspend, or discontinue our Services at any time.
